This document governs access to and use of the smooit.com website (hereinafter the “Application”), operated by Smooit S.r.l.. The Application has informational and commercial purposes and presents IT, cloud, cybersecurity, IT infrastructure and digital solutions services intended primarily for businesses and professionals, allowing them to request information, consulting, technical assessments and quotations.

For the purposes of these Conditions:

- Application: the smooit.com website and its related pages.
- User: any person who accesses or uses the Application.
- Conditions: these general conditions of use of the Application.

Nature and purpose of the Application
The Application presents the professional Information Technology services offered by Smooit S.r.l., including, by way of example, IT consulting and support, infrastructure management and maintenance, servers and private cloud, Microsoft 365, backup, cybersecurity, firewalls, corporate networks and Wi-Fi, VPNs and connections between multiple sites, hardware supply and rental, software development, web applications and customised digital solutions.
Through the Application, Users can consult information about the services offered and submit requests for contact, consulting, technical assessments or quotations. Unless expressly stated otherwise, the Application is not an e-commerce site and does not allow contracts, orders or online payments to be completed automatically.
Any commercial relationship is established subsequently and is governed by the specific proposals, orders, contracts, financial terms or service terms agreed between Smooit S.r.l. and the customer. In the event of a conflict, those specific documents prevail over these Conditions with regard to the individual commercial relationship.

Use of the Application
The User undertakes to use the Application lawfully, properly and in accordance with these Conditions, avoiding activities that could compromise its security, availability, integrity or operation.
In particular, unless authorised or entitled by law, the following are prohibited:
- attempting to gain unauthorised access to systems, restricted areas, servers or data;
- introducing malware or harmful code, or carrying out activities capable of compromising or overloading the Application;
- using the Application for unlawful or fraudulent purposes or in a manner that infringes third-party rights;
- altering, circumventing or interfering with technical security measures or access controls.

Information, quotations and technical content
Information published on the Application is general and informational. Descriptions, features, availability, timeframes, indicative prices, technical compatibility and other content may be updated or changed over time and, unless expressly stated otherwise, do not constitute a binding contractual offer.
Quotations, assessments and commercial proposals become binding only as provided in the relevant documents sent by Smooit S.r.l. and accepted by the customer. The User must verify the suitability of the solutions for their needs before entering into the relevant contract.

Industrial and intellectual property rights
Unless otherwise indicated, texts, documents, graphic elements, layouts, software, original content, trademarks and distinctive signs attributable to Smooit S.r.l. are protected by applicable copyright, industrial property and competition law.
The Application may contain trademarks, logos, names, images or other elements belonging to third parties. These elements remain the property of their respective owners and are used, where applicable, for informational or descriptive purposes or to indicate third-party technologies, products, compatibility, partnerships or services, in respect of the relevant rights.
Without prejudice to uses permitted by law, the content of the Application may not be copied, modified, distributed, republished or commercially exploited without prior authorisation. Technical permission to crawl or index content through robots.txt or similar tools does not, in itself, transfer intellectual property rights or grant additional licences to reuse the content.

Availability and security of the Application
Smooit S.r.l. takes reasonable measures to keep the Application available, up to date and secure, but does not guarantee uninterrupted or error-free operation. Access may be suspended or restricted, including without notice, for maintenance, updates, security measures, failures, unavailability of third-party services or other circumstances reasonably necessary to manage the website.
The User is responsible for the security of their own devices, systems and connections used to access the Application.

Limitation of liability
To the extent permitted by law, Smooit S.r.l. is not liable for service disruptions or malfunctions attributable to the Internet, the User's systems, third-party services or infrastructure, maintenance, force majeure or other circumstances beyond its reasonable control.
Smooit S.r.l. is not liable for improper use of the Application or for decisions made solely on the basis of general information published on the website without the necessary technical or contractual verification.
Any liability that cannot be excluded or limited under applicable law remains unaffected, including liability arising from wilful misconduct or gross negligence where applicable.

Smooit S.r.l. does not control these resources and is not responsible for their content, availability, contractual terms or data processing practices. Governing law and jurisdiction
These Conditions are governed by Italian law.
For Users acting in the course of their business, commercial, craft or professional activities, unless otherwise agreed in writing and to the extent permitted by law, the courts of the place where Smooit S.r.l. has its registered office shall have jurisdiction.
Where a User qualifies as a consumer, the mandatory rules protecting consumers and the jurisdiction provided for by applicable law remain unaffected, including, where applicable, the courts of the consumer's place of residence or domicile.
